Acceptance of Terms
Welcome to SaraWest. These Terms of Service ("Terms") govern your access to and use of the SaraWest website at sarawest.com (the "Site") and any purchases or pre-orders you make through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
You must be at least 18 years old or the age of majority in your jurisdiction to use this Site and make purchases.
Pre-Order Terms & Conditions
All products currently listed on the Site are available for pre-order only. By placing a pre-order, you acknowledge and agree to the following:
- Estimated Ship Date: Pre-ordered products are expected to ship by End of Q3 2026. This is an estimate and not a guaranteed delivery date.
- Payment Authorization: When you place a pre-order, your payment method will be authorized but will not be charged until your order is ready to ship. You may see a temporary hold on your payment method.
- Right to Cancel: You may cancel your pre-order at any time before your payment is captured (i.e., before the order ships) by contacting us at orders@sarawest.com. Once payment has been captured, our standard return policy applies.
- Product Changes: We reserve the right to make minor modifications to product formulations, packaging, or specifications prior to shipment. If material changes occur, we will notify you and offer the option to cancel.
- Delays: If significant delays occur beyond the estimated ship date, we will notify you by email with an updated timeline and the option to cancel for a full refund.
Products & Pricing
We strive to provide accurate product descriptions, images, and pricing. However:
- Colors and appearance may vary slightly due to monitor settings and product photography.
- We reserve the right to correct pricing errors. If an item's correct price is higher than the listed price, we will contact you before processing the order.
- All prices are listed in U.S. Dollars (USD) and do not include applicable sales tax or shipping charges, which will be calculated at checkout.
- We reserve the right to limit quantities, refuse orders, or discontinue products at any time without prior notice.
Payment Terms
We accept payment via the methods displayed at checkout (credit cards, debit cards, and other methods supported by Shopify Payments). By submitting payment information, you represent that you are authorized to use the payment method provided.
For pre-orders, your card will be authorized at the time of order placement but charged only when the product ships. Standard orders (when available) are charged at the time of purchase.
Shipping & Delivery
- We currently ship within the United States. International shipping may be offered in the future.
- Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control.
- Risk of loss and title for items pass to you upon delivery to the carrier.
- Free shipping is offered on orders of $75 or more (contiguous U.S. only, subject to change).
Returns & Refunds
We want you to be satisfied with your purchase. Our return policy is as follows:
- Eligibility: Unused, unopened products may be returned within 30 days of delivery for a full refund of the purchase price.
- Condition: Products must be in their original packaging and in resalable condition.
- Return Shipping: Return shipping costs are the responsibility of the customer unless the return is due to our error (wrong item, damaged product, etc.).
- Refund Processing: Refunds will be credited to your original payment method within 5-10 business days of receiving the returned item.
- Damaged or Defective Items: Contact us within 7 days of delivery at orders@sarawest.com with photos for a replacement or refund.
Intellectual Property
All content on the Site - including text, images, graphics, logos, product names, product formulations, and design - is the property of SaraWest or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Site content without our prior written consent.
User Accounts
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information and to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.
Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose.
- Interfere with or disrupt the Site's functionality or security.
- Attempt to gain unauthorized access to any part of the Site or its systems.
- Use automated tools (bots, scrapers) to access the Site without permission.
- Submit false or misleading information, including fraudulent orders.
- Infringe on the intellectual property rights of SaraWest or third parties.

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Use of our products is at your own risk. Always test products on an inconspicuous area before full application.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SARAWEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless SaraWest and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.
Governing Law
These Terms and any disputes arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in Gray County, Texas.
Dispute Resolution
Before filing any legal action, you agree to first attempt to resolve any dispute informally by contacting us at legal@sarawest.com. We will attempt to resolve the dispute within 30 days.
If informal resolution fails, any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Pampa, Texas. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.
Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on the Site with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
